This Privacy Policy describes how Hot Driver (“Hot Driver”, “we”, “us”, or “our”) collects, uses, discloses, and protects information when you use our mobile applications, websites, and related services that connect merchants, drivers, and customers.

If you do not agree with this policy, please do not use the Services.

2) Scope

This policy applies to customers placing orders, drivers delivering orders, and merchants managing storefronts via the Hot Driver platform (together, the “Services”). Separate terms and agreements may apply to drivers and merchants.

3) Data We Collect

A. Information you provide

  • Account & profile: name, phone, email, photo, delivery address, vehicle details (drivers), ID/license (drivers, where legally required), store information (merchants).
  • Verification & compliance: government ID images, driver’s license, insurance, right-to-work, merchant licenses, tax IDs—collected where required by law or platform integrity.
  • Communications: messages, ratings/reviews, support tickets, call recordings (where permitted and with notice).
  • Order details: items, prices, delivery notes, promo codes, receipts, proof-of-delivery photos/signatures.
  • Payment info: tokens from our payment processor; we do not store full card numbers on our servers.

B. Information collected automatically

  • Device & usage: app version, device model, OS, language, IP address, timestamps, crash logs.
  • Location: precise GPS and network-based location for drivers (foreground/background during active deliveries) and for customers (to set delivery addresses and track orders).
  • Approximate location & motion: to improve route accuracy and fraud prevention.
  • Cookies & similar technologies: on our website and web views; see “Analytics & Cookies”.

C. Information from third parties

  • Identity & safety partners: ID verification, background checks (where permitted by law), fraud screening.
  • Payment processors: payment confirmations, limited card metadata.
  • Merchants & logistics partners: order status, fulfillment, inventory/substitutions.
Permissions we may request in the app: Location, Camera (POD, ID), Photos/Media (upload receipts/POD), Microphone (in-app calls), Push Notifications, Motion/Sensors (route quality), Bluetooth/Wi-Fi (connectivity diagnostics).

4) How We Use Data

  • Provide, operate, and improve the Services, including order placement, dispatching, routing, and real-time tracking.
  • Facilitate merchant menus, pricing, availability, and order fulfillment.
  • Enable driver onboarding, background checks (where permitted), scheduling, navigation, and proof-of-delivery.
  • Process payments and payouts; prevent fraud and chargebacks.
  • Provide customer support, resolve disputes, and enforce our Terms.
  • Personalize the experience (e.g., saved addresses, recent stores).
  • Send transactional communications (order status, receipts, support) and—with your consent or as permitted—service announcements and promotions.
  • Conduct analytics, quality assurance, and safety monitoring.
  • Comply with legal obligations and law-enforcement requests.

6) Sharing & Disclosures

  • Between users when necessary: customers may see a driver’s first name, profile photo, vehicle info, and live location during delivery; drivers see customer first name, drop-off location, and order details. Merchants receive relevant order and delivery details.
  • Service providers & partners: hosting, payments, ID checks, mapping, SMS, analytics, support tools—bound by contract to protect data and use it only for our instructions.
  • Legal & safety: to comply with law, enforce terms, protect rights, safety, and property.
  • Business transfers: as part of a merger, acquisition, financing, or asset sale, with appropriate safeguards.

We do not sell personal information for money. Where “sharing” for cross-context behavioral advertising is defined by law (e.g., CPRA), see “Your Rights”.

7) Location & Background Services

Drivers: We collect precise location in the foreground and, during active delivery windows, in the background to dispatch orders, optimize routes, provide accurate ETAs, and for safety/fraud prevention. You can change permissions in your device settings, but the app may not function correctly without background location while you’re on duty.

Customers: We collect location to set pickup/drop-off points, show nearby merchants, and track orders. Background location is not required for customers.

9) Analytics, Cookies & Marketing

We use analytics to understand usage and improve performance (e.g., crash diagnostics, feature adoption). On web properties, we use cookies and similar technologies. Where required, we present a consent banner and respect your choices.

  • Essential: required for core functionality (security, login, order flow).
  • Performance/Analytics: usage statistics and diagnostics.
  • Marketing (optional): only with consent where required.

10) Data Retention

We retain information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Typical retention examples:

  • Account data: while your account is active and for a reasonable period thereafter.
  • Transaction & tax records: retained per applicable law (e.g., 3–10 years).
  • Location logs for deliveries: retained for operational, safety, and dispute-resolution windows, then aggregated or deleted.

11) Security

We implement technical and organizational measures (encryption in transit, access controls, monitoring). No method of transmission or storage is 100% secure; we cannot guarantee absolute security.

12) Your Privacy Choices & Rights

Access, correction, deletion

You may access and update your profile in the app. To exercise rights (access, portability, rectification, deletion, restriction/objection), contact us at [[privacy@hotdriver.codexal.co]]. We will verify your request and respond within the time required by law.

Marketing & notifications

Manage marketing preferences in the app or by using “unsubscribe” links. Control push notifications in device settings.

Cookies

On web, you can manage cookie preferences via our banner (where available) or your browser settings.

EEA/UK

If GDPR/UK GDPR applies, you may have the right to lodge a complaint with your local supervisory authority.

California (CCPA/CPRA)

  • You may request to know, delete, or correct personal information, and to opt-out of “sharing” for cross-context behavioral advertising (if applicable). We do not sell personal information for money.
  • Submit requests: [[privacy@hotdriver.codexal.co]]. Authorized agents may act on your behalf subject to verification.
  • We do not use or disclose sensitive personal information for purposes beyond those permitted by CPRA §1798.121.

13) Children’s Privacy

The Services are not directed to children under 13 (or older, where restricted by local law). We do not knowingly collect personal information from children. If you believe a child has provided personal information, contact us to request deletion.

14) International Data Transfers

Your information may be transferred to and processed in countries other than your own. Where required, we use appropriate safeguards (e.g., Standard Contractual Clauses) to protect cross-border transfers.

15) Changes to This Policy

We may update this Policy from time to time. We will post the updated date at the top and, where required, notify you through the app or by email. Your continued use of the Services after an update constitutes acceptance.
